Off-road decree: what the new regulation says. Ancma and IMF are not there

The so-called “Off-road Decree” has been published in the Official Gazette: what changes and on which routes it is no longer possible to drive with the engine running. Ancma and IMF opposed

The decree of 28 October 2021, published in the Official Gazette on 1 December last and available for consultation at this link the off-road world is not a little worried. What is it about? Of the “provisions for the definition of the minimum national criteria inherent to the purposes, types and technical-constructive characteristics of forestry and forestry-pastoral traffic, of the works connected with the management of the woods and the hydraulic-forest arrangement”. That is, it implies the viability on dirt roads. The decree of 28 October was signed by the Minister of Agricultural, Food and Forestry Policies Stefano Patuanelli, in office since 13 February 2021 in the Draghi government, of the Minister of Culture Dario Franceschini, in office since 5 September 2019, and by the Minister of Ecological Transition Roberto Cingolani, operational from 1 March 2021.


The text reads: “Regardless of the title of ownership, the forest and forestry-pastoral viability and the related works as defined in the following art. 3 are prohibited for ordinary transit “. Therefore, these routes would no longer be subject to the normal circulation of vehicles that are not included in the table attached to the decree itself. And therefore for motorcycles, quads, 4x4s and bicycles, since reference is made exclusively to work vehicles whose purpose is to maintain and restore the aforementioned roads.

And now?

If this decree is applied (the date is strict, Thursday 16 December) the off-road world will have to reinvent itself. Now we just have to wait and see the developments. We know for sure that the Italian Motorcycle Federation and some associations are working to better understand the situation and find a solution (whether it is the modification of the decree in question or review the speech with a new law) that could be the right key for everyone.

Ancma and IMF also opposed to the ban

The first reactions from the community of enthusiasts were not long in coming. The decree, which effectively prohibits the circulation of off-road vehicles, motorbikes and cars on natural roads less than 2.5 meters wide, is an insurmountable obstacle for the off-road world. In addition to online petition on directed to the institutions and in particular to the Presidency of the Council of Ministers, ANCMA and IMF have also taken a stand by taking sides against the Decree. The manufacturers’ association and the Italian Motorcycle Federation have entrusted their opinion on the rule, defined as “short-sighted and with possible unconstitutionality profiles that creates serious economic damage to the two-wheel sector”, to a press release. Not only that, because ANCMA and IMF have activated in these hours an interview with the Government “in order to obtain clarifications and a correction of the provisions contained in the Decree”.
